BI LATERALS

U.S. Russia relations - START-I and Russia – NATO council are signs of post cold war normalisation. Warsaw Pact is disbanded. NATO reform plans in November 2010 at Lisbon. So these are convergence trend in their relationship. Russia’s Nord stream and south stream (of gas) to Europe. Russia also does not want to expel USA from Manas military base of Kyrgyzstan. All this is ‘reset’ of relations.

Philippines - USA will resist any change in “visiting Forces

agreement”.

Entities List - A list of organisations with which USA cannot

trade (in India). It is for US export control

over dual use items to India. US may revise

the list and liberalise the trade now.

China Japan - Japan had invaded Manchuria (China) in 1932

Now-Senkaku Island (Japanese), called as Diaoyu by China. Both claim this Island.

Indo U S Strategic - CISMOA (Communication & Security

Memorandum of Agreement), BECA (Basic

Exchange and Cooperation Agreement

for Geospatial Cooperation) are to be discussed

China Myanmar - New rail link from Kyauphyu port of

Russia Norway - Demarcate their areas in Barrent sea and

Arctic ocean. Barrent Archipelago of

Svalbard is situated close to 80th parallel.

They resolve their dispute over 1,75,000

Sq k.m. area after 40 years negotiation.

CONSTITUTION AND LAWS

Eminent Domain - It is the legal doctrine which holds that

State is the pre eminent holder of all land.

Upper House - Tamil Nadu will get back

Article 243S(3) & (6) and - Quota in local bodies and reservation of

Article 243T(4)&(6) chairperson’s post are upheld by Supreme

Court.

Ancient Monuments & Architec-

tural Sites & Remains Act(1958) - To be amended. It will prevent vandalism,

theft, enchroachments. But the Act will apply

to only 3675 monuments protected by the

ASI. There are 7 lakhs.

Section 375 of IPC - Rape & Sexual assault – change in law.

Selvi Vs Karnatak - Supreme Court declares Narco Analysis to be

Unconstitutional (on 5th May 2010). “Due

Process” was first used in Magna Carta. Article

20(3) of India is a right against self – incrimination.

New CRZ rule - It increases number of coastal zones from

3 to 5. It also includes sea-ward side for

protection. The cut off year for regularising

constructions is 1991. H.T.L. (High Trade

Line) to be demarcated. Also a H.L. Hazard

Line.

Nuclear Civil Liability Bill - ‘Right to Recourse’ of Sec 17(b). All

Liability is of the operator of the nuclear plant. But under ‘right to recourse’ it has the

right to recover any compensation it is

forced to pay, if the accident is due to the

gross negligence of the supplier and there is

a provision in the contract for it. Thus the

liability is channelled to the supplier.

National Litigation Policy - To transform Govt. from a compulsive

litigant to a responsible and even reluctant

litigant. Frequent adjournments will not be

allowed. In service matters individuals cases

will not be appealed.

N C H R H Bill - National Council for Human Resources in

Health Bill. It will be the final body in health

sector, It creates a National Committee for

Accreditation and a National Medical

Education & Training Board.

Dodd – Frank Bill - Of USA Wall Street reforms and Consumers

protection Bill ( Barney Frank & Chris Dodd).

It will reduce abusive use of mortgage

industry and give more information to

ordinary investors about costs and risks of

investment products.

Ancient Monuments and

Archeological Sites & Remains Act - It creates National Monuments Authority

Which will protect 3675 centrally protected

monuments. Heritage by-laws will over ride

Building by laws 300 metres around

the monuments.

Securities and Insurance - It will create a joint mechanism to resolve

Laws (Amend) validation Bill 2010 differences between RBI, IRDA, SEBI. FM is

Chairman, RBI Governor is vice chairman.

High Court Judges - Retirement age increased from 60 to 62 in

1963.

Public Interest Disclosure - Their identity to be protected by CVC with

(Protection of informants) power of a civil court.

Border Security Bill (USA) - Visa fees increased to $ 2000.

Nuclear Liability Bill - India follows convention for supplementary

compensation of 1997. Supplier is

accountable for an accident only if it has

agreed to ‘Right of Recourse” in a written

contract. The operator is allowed ‘Right of recourse’ if the accident takes place due to

gross negligence of supplier or by a defective

equipment.

Right to Recourse - Section 17(b)

Nuclear Liability - Government has introduced ‘intent to cause

nuclear damage as a condition for suppliers

liability. So the supplier will go away with no

liability.

Intent clause dropped. Also no contract is necessary for right to recourse. Operator’s liability is increased to Rs.1500 crore. Beyond this is Govt’s liability. 300 million SDR is equal to Rs.2100 crore.

Srilanka - 1978 constitution is amended to waive the

bar of two terms on President.

CAT : Convention against torture of U N. India

signed in 1977. Now prevention of torture

Bill. Torture is cruel, inhuman and

degrading treatment or punishment. But in

Indian definition it includes injury to limbs.

Enemy Properties Act (1968) : Its proposed amendment authorises Govt.

to dispose of the property.

Enemy Property Ordinance (2010) : As per Enemy Property Act 1968, Government

can take custody of properties of enemy

citizens. This Act was passed after 1965 Indo-

Pakistan war. In 2005 Supreme Court had

Ordered that enemy property of Raja of

Mahmoodabad (who is a Pakistan citizen) be

given to his son Md .Khan who is an Indian

citizen. The July 2010 ordinance repudiated

the judgement. However, the bill introduced

in Parliament has been withdrawn to be re-

introduced later.

Bangladesh : Supreme Court strikes down 5th Amendment

(1976) material law and 7th Amendment 1988) (Inslamisation). There is no place for

material law in civil society.

Turkey : Constitution referendum. Package by AKP

(Justice & Dev. Party). Military made more

accountable to civil courts. It lifts immunity

to 1980 coup plotters. Following which the

new constitution was drafted. A praetorian

State, there were 4 coups between 1960 and

2000. Mustapha Kamal was himself a soldier.

114 Amend Bill : Article 217(1) and 224(3) – retirement age of

High Court Judges to 65. (7th Amendment -

it was increased from 60 to 62 in 1956.)

Judicial Accountability Bill : It will create a committee consisting of five

Persons – An Ex-CJI (Chairman), one serving

Justice of Supreme Court and one from High

Court, Attorney General and one eminent

Citizen nominated by president.

18th Amend of Pakistan :

Judicial standards and : It creates a National Judicial Oversights

Accountability Bill 2010 Committee – N J O C.

Protection of women against Sexual : It ensures safe environment in work place

Harassment at workplace bill 2010 both public, private in organised and

unorganised sectors. But domestic helps

are kept out of its purview. It proposes a

fine of Rs.50,000/-. It follows the definition

of sexual harassment as laid down by

Supreme Court in Vishaka Vs State of

Rajasthan in 1997. It is meant for woman

employees, clients, customers, apprentices

etc.. Every employer will have an internal

complaints committee except where the

employees are less than 10.

Habeas Corpus Judgement : ADM Jabalpur Vs Shivkanta (during

Emergency). The Supreme Court nullified

the stay granted by Mumbai High Court

against R. Jethmalani’s arrest.

Tural Sites Act 2010 : Minimum ‘prohibited area’ is 100 metres and

‘regulated’area is 200 metres. No construction

within prohibited area.

Section 124 A of I P C : Sedition charge against Binayak Sen. But in

1962, in Kedarnath Singh vs. State of Bihar,

Supreme Court had stated that unless dis-

affection against the state is spread by the

accused, there cannot be sedition charge.
